Our attorneys who specialize in real estate practice have decades of combined experience in general commercial and construction financing, land use matters, leasing, and other aspects of real estate and business ownership. Our firm represents lenders, corporations, partnerships and individuals in securing financing for commercial transactions. We have successfully represented lenders in protecting their interests in the context of loan transactions, as well as in negotiating and restructuring problem loans. Our attorneys are experienced in foreclosing and repossessing borrower assets to protect creditors' rights. We also represent borrowers with significant financial resources in negotiations with lenders in large commercial transactions. Those of us who specialize in real estate also work closely with our attorneys who specialize in environmental law, the litigation of land use issues, and bankruptcy. All of these specialties may be required when dealing with the current loan workout situations we confront.

The focus of our real estate attorneys has always been on "making the deal work." As economic conditions strain those deals, we take a team approach in bringing to bear the insolvency, bankruptcy, litigation, environmental and secured transaction skills of our lawyers to achieve our client's objectives. Whether the deal involves putting together a complex multi-million dollar loan financing or negotiating the takeover of a business, our goals are to understand our client's objectives, to anticipate and eliminate obstacles that stand between our client and his or her objectives, and to complete the transaction on a schedule that suits our client's needs. Among our firm's areas of representation are:

  • Assisting lenders in secured-lending transactions and in efforts to protect their investment in declining economic conditions
  • Representing borrowers in negotiating sophisticated financing arrangements; Assisting borrowers in understanding and resolving the often complex title, zoning, or environmental issues which are necessary to achieve financing and close a deal;
  • Representing developers before town, municipal, and state authorities on development matters including the registration of subdivisions and condominium projects with the appropriate authorities;
  • Assisting clients in resolving conservation matters with appropriate state departments;
  • Assisting both lenders and borrowers in workout problems associated with commercial loans; and
  • Assisting lenders or purchasers in purchase and sale negotiations and related documentation and sale/lease-back arrangements, like-kind exchanges and other complicated real estate transactions.
