Construction Litigation

McLane's Construction Practice Group is comprised of attorneys of diverse disciplines who have the expertise to meet all the construction-related needs of our clients, whether they are owners, architects, engineers, construction managers, general contractors or subcontractors. Our attorneys represent clients in all phases of construction projects – whether it's helping clients form business entities for construction projects; drafting, reviewing and negotiating construction contracts; obtaining land use and environmental permits; assisting clients with dispute resolution; or providing aggressive representation in arbitration or litigation.

The Construction Practice Group works closely with attorneys in our firm's real estate, environmental, employment, tax, corporate and litigation departments to draw on their varied experiences to ensure that all of our clients' needs our met. We recognize that it is critical for our construction clients to have lawyers who understand all facets of their particular construction projects. McLane's construction lawyers have the expertise to provide effective guidance at the outset of each project, and guide each client through the various hurdles that face most construction projects until completion and beyond.

We understand that on construction projects time is money, and we pride ourselves on being exceedingly responsive to our clients. When obstacles or disputes arise – such as OSHA issues, permitting challenges, delay claims, payment disputes – our construction litigation team works efficiently to guide clients to the most practical and favorable resolution. Indeed, our construction trial lawyers have successfully represented clients in a large variety of matters.

Disputes that we've handled include:

  • Represented a prominent college in litigation involving design and renovation of its state-of-the-art geology and geochemical laboratory facility;
  • Represented a large manufacturing facility in litigation arising out of design and construction of a co-generation facility in Manchester, N.H.;
  • Represented a general contractor in defending against construction bond claims brought by a subcontractor concerning Bedford (N.H.) High School;
  • Served as counsel to a New Hampshire engineering firm in dispute over design and installation of large athletic field complex at a New Hampshire high school;
  • Represented a New Hampshire engineering firm in litigation involving design and installation of municipal sewer and water system;
  • Served as counsel to heating oil distributor in litigating claims over design and installation of state-of-the-art oil storage facility in Manchester, N.H.;
  • Defended a New Hampshire engineering firm against claims of defective design of water and sewer system for large mobile home park;
  • Represented a private school in a claim against an architect relating to specification of exterior sheathing inappropriate for New Hampshire climate;
  • Represented numerous individual property owners in seeking recourse for design and construction defects;
  • Assisted many general contractors and subcontractors in securing mechanics liens to ensure proper payment.
