Land Use

Our skilled real estate attorneys can assist you in reaching your land use objectives. We represent developers, business and individuals in seeking variances and special exceptions from planning boards and zoning boards of appeal. Our attorneys are also active in helping telecommunications and pharmaceutical clients obtain required permits from local planning officials. Examples of some of the land use issues we have successfully addressed for clients include:

  • Creating conservation easements for two major holdings of an environmental education organization;
  • Advising investors on the purchase of historic property, including potential regulatory issues affecting renovation of the property for commercial use; and
  • Counseling developers related to "fair share" infrastructure assessments sought by local governments

We have successfully handled a number of land use lawsuits as well. For example, we obtained a jury verdict over $1 million in New Hampshire state court in favor of a commercial landowner in an eminent domain dispute with the state. Following trial in a separate case, we obtained on behalf of a commercial real estate developer an injunction restraining the excessive use of an easement. Other land use litigation we have handled includes a Massachusetts Land Court matter in which we represented the landowners in appealing the denial of a zoning variance.
