Representative Litigation Cases in Massachusetts

  • Thomas Sullivan v. Jen-Coat, Inc. 3:14-CV-30200 – United States District Court for the District of Massachusetts Western Division.  Defended employer in action removed from Commonwealth court to federal court on claims of violation of Massachusetts law on discrimination against the handicapped, M.G.L. 151 B and violation of the federal Americans with Disabilities Act.
  • Raid Inc. v. HJ Brooks, LLC, Massachusetts Superior Court, Essex County, Civil Action 10-1533 – represented company in bringing breach of contract and related claims against lessor; Order granting judgment in favor of plaintiff as to liability on breach of contract and breach of good faith and fair dealing; Order granting plaintiff’s motion to assess damages and obtained award of attorney’s fees and costs for plaintiff.
  • Plaistow Project, LLC v. A.C.E. Property and Casualty Company, U.S. District Court, D. Mass. (September 12, 2018) (Court determined as a matter of law that insurer breached its duty to defend insured in underlying suit alleging environmental contamination where summary judgment was granted against insured for $2.9 million following the insurer’s failure to defend). 
  • Metric Construction v. Chick Lumber, Docket No. 13-13119-NMG.  (2 years in U.S. District Court in Boston).  We represented a large flooring supplier and installer in an action brought by large general contractor, and the litigation involved a number of claims and counterclaims.  The case resolved shortly before trial and after a full day of mediation with Magistrate Judge Bowler.
  • Eversource – North Atlantic Energy Service Corporation and Northeast Utilities Service Company (NAESCO v. The Massachusetts Municipal Wholesale Electric Company (MMWEC) – Arbitration over pension liability costs
  • SEC v. Howard Present:  Representation of co-founder and former board member of investment management firm with $28B in assets under management in SEC enforcement investigation and trial for alleged false advertisement  of investment product.
  • Randall v. A.D. Makepeace Company (MCAD complaint).  The plaintiff claimed that we discriminated against her based upon sex and age. We won the matter at the preliminary screening stage.
  • Obtained a jury verdict in favor of our client, the personal representative of his mother’s estate, in a suit brought by his brother in Middlesex County Superior Court, in which the brother alleged that he had been promised a larger portion of the estate.
  • Obtained a judgment in favor of our client, a search engine optimization firm, in a bench trial in Malden District Court, for breach of contract.
  • Reached a favorable resolution through mediation in a dispute over a residential real estate development project, involving extensive discovery and accounting issues.
  • Defended a personal representative against an estate beneficiary’s challenges to the estate accounting; reached a favorable resolution during trial in Suffolk County Probate and Family Court.
