Adam is a Director and the Chair of McLane Middleton’s Administrative Law Department where he has been a practicing attorney for over 15 years.  Adam’s practice focuses on environmental and energy issues, where he assists clients in matters involving environmental permitting and compliance counseling, energy facility siting, and defense of enforcement actions.

Adam helps businesses, municipalities, and individuals navigate the intricacies and complexities of federal, State, and local environmental laws and regulations, including, the Clean Water Act, Clean Air Act, Comprehensive Environmental Responsibility, Compensation, and Liability Act (CERCLA), Resource Conservation and Recovery Act (RCRA), Federal Power Act, Emergency Planning and Community Right to Know Act (EPCRA), Toxic Substances Control Act (TSCA), Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) and the Occupational Health and Safety Act (OSHA).  Adam has been at the forefront of the ever-developing regulations regarding emerging contaminants, including PFAS.  Adam also defends national, regional, and local clients facing administrative or civil enforcement actions and citizen suits.

Adam received his J.D. from Vermont Law School, magna cum laude, and B.A. from Providence College. While in law school, he served as an article editor on the Vermont Law Review and was a Judicial Intern for the Honorable Peter W. Hall of the United States Court of Appeals for the Second Circuit. Additionally, Adam was a Legal Intern for the United States Environmental Protection Agency in Region 1 and the Environmental Protection Unit of the Office of the Vermont Attorney General.

Before joining McLane Middleton, Adam served as an Assistant District Attorney for the Suffolk County District Attorney’s Office in Boston, Massachusetts and was a judicial law clerk for the New Hampshire Superior Courts. Prior to law school, Adam was an environmental claims adjuster for Travelers Insurance.

Representative Matters

  • Successfully represented and defended numerous businesses regarding air emissions and water discharges.
  • Obtained dismissals of lawsuits for alleged violations of hazardous waste laws and regulations.
  • Successfully permitted the construction and operation of several electric transmission lines before multiple State agencies and the NH Site Evaluation Committee.
  • Represent multiple clients in CERCLA Section 107 and 113 cost recovery and contribution actions.
  • Assist clients in navigating compliance issues related to the pretreatment and discharge of industrial wastewater to wastewater treatment facilities.
  • Advise multiple sand and gravel, construction aggregate, and dimensional stone mining companies on State and local permitting requirements.
  • Negotiate an Environmental Services Cooperative Agreement with the United States Navy regarding alleged contamination of public water supplies.
  • Represent hydroelectric facilities before the Federal Energy Regulatory Commission (FERC) and NHDES Water Council.
  • Defense of State and federal allegations regarding violations of the Lead Paint Disclosure Act and Lead Based Paint Renovation, Repair, and Painting.
  • Advise clients regarding the redevelopment of brownfields.
  • Represented multiple clients in Clean Water Act, Safe Drinking Water Act, and Clean Air Act cases involving PFAS regulation.
  • Defended a waste hauler and asbestos contractor from alleged violations of asbestos regulations.
  • Assist municipalities with National Pollutant Discharge Elimination System (NPDES) permitting and enforcement of the same.
  • Advise on mergers and acquisitions, stock and asset sales, and sales of land and businesses regarding environmental due diligence, including, Phase I and Phase II Environmental Site Assessments.
  • Represent clients before local land use boards regarding environmental and solar development matters.
  • Assist municipalities with dam removal permitting.
  • Successfully represented and defended an electric generation facility and other manufacturing and industrial clients from allegations regarding unlawful air emissions.
  • Negotiated a $450 million 20-year consent decree with US EPA, US DOJ, NHDES, and NH DOJ regarding alleged violations of the Clean Water Act stemming from combined sewer overflows.
  • Assisted public, community and academic organizations with solar power purchase agreements.
  • Assist individual homeowners with wetlands and shoreland matters include wetlands and shoreland permits and mooring permits and defense of enforcement actions.
  • Represent clients before the NH Department of Environmental Services Water Council, Wetlands Council, and Air Council.
  • Successfully defend clients from enforcement actions under Massachusetts General Law Ch. 21E (Massachusetts Contingency Plan).
  • Successfully defended claims brought by various NH Licensing Boards.
